Terms of Service.

These terms set out how we work together: how bookings and payments run, who owns the images, and what you can do with them. We keep it fair and clear.

Agreement to these terms

By booking a session, paying for it, or using our galleries and images, you agree to these terms. If a signed contract for a specific project says something different, that contract controls for that project.

Our services

Zoomatic Visuals provides photography services, including brand, personal branding, commercial, food, event, nightlife, automotive, portrait, and social content photography, along with editing, private online galleries, and print ordering.

Bookings and payment

  • Selecting a date and time online reserves that time. It is not yet a confirmed booking.
  • After you select a time, we will contact you to arrange payment using a method you prefer.
  • Your booking is confirmed once payment is received. A time that is not paid for within 24 hours may be released and offered to another client.
  • Commercial projects, campaigns and custom shoots are quoted separately and may be invoiced on terms agreed in writing.

Cancellation and rescheduling

  • You may reschedule once at no charge with at least 48 hours notice. Your payment moves with you to the new date.
  • For changes with less than 48 hours notice, or for a cancellation, we may retain part of the payment to cover the reserved time.
  • If we ever have to cancel for a reason on our side, you may choose a new date or a full refund.

Payments

Payments are arranged directly with you, or by invoice for commercial work. Prices are shown on the Investment page and confirmed at booking. You are responsible for any applicable taxes. We do not accept card payments and never collect or store card details.

Your responsibilities

  • Provide accurate details and arrive, or have your venue ready, on time.
  • Secure any permits, venue permissions, or access the shoot needs.
  • Obtain any consents required for people appearing in the images.

Zoomatic Visuals owns the copyright in all images we create. On full payment, we grant you a license to use your delivered images for the purposes we agree, such as personal use, your brand, and your social channels.

  • Please do not alter, add filters to, or crop the images beyond what we deliver, so the work stays consistent with our style.
  • Please do not sell, license, or submit the images to contests as your own.
  • We retain the right to use the images to promote our work, unless we agree otherwise in writing.
  • Commercial or extended usage rights can be arranged as part of a custom quote.

Delivery and galleries

We deliver images through a private online gallery. Social ready selects typically arrive soon after the session, with the full retouched gallery following after that. Galleries stay available for the period stated at delivery. Please download and back up your files during that time.

Print orders

Prints ordered through your gallery are produced by our print provider. Colors on a screen can differ slightly from a printed piece. If a print arrives damaged or is not what you ordered, contact us and we will make it right.

Limitation of liability

We take great care on every project. To the fullest extent allowed by law, our total responsibility for any claim connected to a session is limited to the amount you paid for that session. We are not responsible for indirect or consequential losses.

Events outside our control

If something beyond reasonable control, such as illness, severe weather, equipment failure, or a venue issue, prevents a session, we will work with you to reschedule at the earliest opportunity.

Governing law

These terms are governed by the laws of the State of New York. Any dispute will be handled in the courts located in New York, unless the law provides otherwise.
